The Henry County Fiscal Court met in a special session on February 28, 2005 in the Judge Executive’s office in New Castle with the following in attendance:

Honorable Peggy Bryant, Deputy Judge Executive
Honorable Virginia Harrod, County Attorney
Esquire John Allgeier
Esquire Jerry Beasley
Esquire David Brown
Esquire Mike Fisher
Esquire Wayne Gunnell
Esquire Cecil McCarty
RE: CALL TO ORDER
Judge Executive, John L. Brent called the meeting to order and noted everyone was present.
RE: SUSPENSION OF MINUTES
Upon motion by Esq. Allgeier and seconded by Esq. Brown, it is ordered by the Court to suspend the reading and approval of the minutes from the February 22, 2005 meeting.
Motion carried unanimously
RE: 1ST READING AND APPROVAL OF PROPOSED NON-EXCLUSIVE DUMPSTER ORDINANCE
Virginia Harrod, Henry County Attorney and Josh Clubb, Solid Waste Attorney reviewed and discussed the proposed Non-Exclusive Dumpster Ordinance and the amendments to the Non-Exclusive Dumpster Franchise Agreement with the Court and those in attendance.
Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court to approve the 1st reading of the proposed Non-Exclusive Dumpster Ordinance.
Motion carried unanimously
Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court that all providers of dumpster service shall have 30 days after the enactment of this ordinance to comply with the provisions hereof and of the provisions contained in the Henry County Dumpster Non–Exclusive Franchise Agreement.
Motion carried unanimously
RE: 1ST READING OF AMENDMENT TO NON-EXCLUSIVE DUMPSTER FRANCHISE AGREEMENT
Upon motion by Esq. Gunnell and seconded by Esq. Allgeier, it is ordered by the Court to approve the 1st reading of an amendment to the Non-Exclusive Dumpster Franchise Agreement.
Motion carried unanimously
RE: ADJOURN
Upon motion by Esq. Fisher and seconded by Esq. Beasley, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and the County Attorney shall receive a typed copy of the minutes prior to the next regularly scheduled meeting.
Motion carried unanimously
