HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
JANUARY 18, 2005

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a regular session on January 18, 2005 at the Courthouse in New Castle, Kentucky with the following in attendance:

Esquire John Allgeier
Esquire Jerry Beasley
Esquire David Brown
Esquire Mike Fisher

RE: PLEDGE OF ALLEGIANCE

Judge Executive John Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER & PREPARATION

Silent prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Executive John Brent called the meeting to order and noted everyone present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Gunnell and seconded by Esq. Brown, it is ordered by the court to amend the minutes from the December 21, 2004 regular meeting in regards to Josh Clubb. The amendment states Josh Clubb should not participate in representing any Planning and Zoning legal issues.

Motion carried unanimously

Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court to approve the minutes from the December 21, 2004 regular meeting with the amendment.

Motion carried unanimously

RE: OLD BUSINESS

There being no Old Business, the meeting proceeded with New Business.

RE: NEW BUSINESS

RE: ROAD DEPARTMENT UPDATE

Glenn Baxter, Road Supervisor gave an update on roads.

Peggy Bryant gave a report on the FEMA projects.

RE: EMS UPDATE

Jarrod Sights, EMS Supervisor gave a recap of the runs made for the month of December.

RE: KY TRANSPORATATION DEPT. - 5th DISTRICT

Chris Smith with the KY Transportation Dept.-5th District gave an update on rural secondary road proposals for 2005-2006. No action was taken at this time.

RE: COURTHOUSE ELEVATOR UPDATE

Architect Chris Cottingim gave an update on the courthouse elevator project.

RE: WASTE WHEELER PROPOSAL -ADDENDUM TO FRANCHISE AGREEMENT

Upon motion by Esq. Brown, and seconded by Esq. Allgeier, it is ordered by the court to accept the addendum to the Franchise Agreement between Rumpke and Henry County Fiscal Court. The addendum will offer one Waste Wheeler to all Henry County residents outside the incorporated cities at no charge to the resident. The $1.00 monthly fee will be remitted from the County’s franchise fees, which Rumpke pays the court per the Henry County Exclusive Franchise Agreement.

RE: JAIL UPDATE – JAILER NEIL STIVERS

Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the court to allow Jailer Neil Stivers to keep all current part time employees. Upon installation of the arraignment equipment the court will review the number of part time jailers needed.

RE: FEBRUARY FISCAL COURT MEETING – RESCHEDULE FROM THE 15TH TO THE 22ND

Upon motion by Esq. Gunnell, and seconded by Esq. McCarty, it is ordered by the court to move the February meeting from the 15th to the 22nd so the Court may attend the annual KAKO legislative day.

Motion carried unanimously

RE: MOTION TO MOVE INTO EXECUTIVE SESSION

Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the court to move into executive session to discuss litigation.

Motion carried unanimously

RE: MOTION TO MOVE OUT OF EXECUTIVE SESSION

Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the court to move out of Executive session.

Motion carried unanimously

RE: MOTION TO MOVE INTO REGULAR SESSION

Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the court to move back into regular session.

Motion carried unanimously

RE: CLAIMS & TRANSFERS

Upon motion by Esq. Allgeier and seconded by Esq. McCarty, it is ordered by the court to approve the following claims and transfers:

GENERAL FUND $133,490.63
ROAD & BRIDGE 48,616.61
JAIL FUND 47,440.44
FEDERAL GRANT 7,347.00
911-EMS FUND 16,473.25
FAIR FUND 1,912.40
L.G.E.A. FUND 640.00

TOTAL CLAIMS

$255,920.33

RE: ADJOURN

Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the court to adjourn and each Magistrate, the Judge Executive and County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
