The Henry County Fiscal Court met in a regular session on November 15, 2005 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE
Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.
RE: PRAYER & PREPARATION
Silent prayer was observed in preparation for the meeting.
RE: CALL TO ORDER
Judge Executive John L. Brent called the meeting to order and noted everyone was present.
RE: APPROVAL OF MINUTES
Upon motion by Esq. Allgeier and seconded by Esq. Brown, it is ordered by the Court to approve the minutes from the October 18, 2005 regular meeting.
Motion carried unanimously
RE: OLD BUSINESS
RE: HAZARDOUS SUBSTANCES ORDINANCE – 2ND READING
Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the Court to approve the second reading of the Hazardous Substances Ordinance.
Motion carried unanimously
RE: NEW BUSINESS
RE: ROADS
1. Update from Glenn Baxter
Henry County Road Supervisor, Glenn Baxter informed the Court that MAGO has completed all blacktopping contracts, all cribbing is in, and the FEMA projects completed. He
noted the auction brought in over $9,000.00.
2. Bid Opening for Hance’s Bridge on Six Mile Road
The following Bids were received:
Kakrsner Construction Co. Inc. $65,902.00
Bond Brothers, LLC $92,230.00
Upon motion by Esq. Fisher and seconded by Esq. Brown, it is ordered by the Court to table the decision for Hance’s Bridge until Glenn Baxter has an opportunity to get more description and detail from the low bidder.

RE: EMS
1. Insurance Billing Recommended Changes
Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court to approve the base rate changes submitted by SDI.

2. Advisory Council Recommendation to Consolidate under same EIN number
Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court to allow all volunteer squads to consolidate under one EIN for billing purposes with
all money coming to the county and a check sent to each squad once a month.
Motion carried unanimously
RE: KY SEARCH AND RESCUE SQUAD ORDER OF AFFILIATION
Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to establish a KY Search and Rescue Squad Order of Affiliation under the command of DES Coordinator Bruce Owen.

RE: AG DISTRICT RECOMMENDATION – CRAVENS ON TURKEY RUN ROAD
Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to recommend to the Soil Conservation Board that the Cravens farm on Turkey Run Road be added to an existing Ag district.

RE: BOARD OF ADJUSTMENT TERM APPROVALS – DENTON, YEARY, & WEST
Upon motion by Esq. Fisher and seconded by Esq. McCarty, it is ordered by the Court to reappoint Frank Denton, Dennis Yeary, and Adam West to serve on the Henry County Board of Adjustments for another term of 4 years.

RE: P & Z COMMISSION – DISTRICT 3 RECOMMENDATION
Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to recommend Terry Rowlett to serve on Henry County P&Z Commission.

RE: EXTENSION COUNCIL BOARD RECOMMENDATIONS –LARRY JEFFRIES & BILL BURCKLE
Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to approve the council recommendations of Larry Jeffries and Bill Burckle to a new term.

RE: COUNTY HEALTH INSURANCE PLAN FOR 2006 – SCOTT BROWN OF BROWN INSURANCE CO.
Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court to approve employee health insurance through Brown Insurance Agency. The provider will be United Healthcare and the cost to the County will be $310.67 per employee with the employee to contribute the difference.

RE: 2005-2006 BUDGET AMENDMENT –1ST READING – RELATING TO ELEVATOR PROJECT, EMS, COP’S GRANT & LITTER GRANT
Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to approve the 1st reading of the 2005-2006 budget amendment. (Amendments are attached.)

RE: HENRY COUNTY SENIOR CENTER RESOLUTION FOR CDBG FUNDS
Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the Court to approve the resolution for CDBG Funds.

RE: SHERIFF’S & COUNTY CLERK’S BUDGET PRESENTATION
The Sheriff’s and County Clerk’s Budgets were presented to the Court.
RE: ESTABLISH REVIEW COMMITTEE FOR SHERIFF’S & CLERKS’S BUDGETS
Judge Brent, Esq. Gunnell, and Esq. McCarty agreed to serve on the committee to review the Sheriff’s and Clerk’s budgets.
RE: CLOSED SESSION TO DISCUSS PENDING LITIGATION
Upon motion by Esq. Allgeier and seconded by Esq. Fisher, it is ordered by the Court to move into Executive Session to discuss pending litigation.

RE: MOTION TO MOVE OUT OF EXECUTIVE SESSION
Upon motion by Esq. Fisher and seconded by Esq. Brown, it is ordered by the Court to move out of Executive Session.

RE: MOTION TO MOVE INTO REGULAR SESSION
Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court to move back into regular session.

RE: CLAIMS AND TRANSFERS
Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to approve the following claims and transfers:
