HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
MARCH 15, 2005

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a regular session on March 15, 2005 at the Courthouse in New Castle, Kentucky with the following in attendance:

Honorable John L. Brent, County Judge Executive
Esquire John Allgeier
Esquire Jerry Beasley
Esquire David Brown
Esquire Mike Fisher
Esquire Wayne Gunnell
Esquire Cecil McCarty

Absent: Honorable Virginia Harrod, County Attorney

RE: PLEDGE OF ALLEGIANCE

Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER AND PREPARATION

Silent prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Executive John Brent called the meeting to order and noted everyone was present except the County Attorney, Virginia Harrod.

RE: APPROVAL OF MINUTES

Upon motion by Esquire Allgeier and seconded by Esquire McCarty, it is ordered by the Court to approve the minutes from the February 22, 2005 regular meeting.

Motion carried unanimously.

Upon motion by Esquire Brown and seconded by Esquire Beasley, it is ordered by the Court to approve the minutes from the February 28, 2005 special meeting.

Motion carried unanimously.

RE: OLD BUSINESS:

RE: MAP APPROVAL

Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court to approve the maps done by KIPDA.

Motion carried unanimously.

RE: NON-EXCLUSIVE DUMPSTER FRANCHISE AGREEMENT – 2ND READING

Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court to approve the 2nd reading of the Non-Exclusive Dumpster Franchise Agreement.

Motion carried unanimously.

RE: NON-EXCLUSIVE DUMPSTER ORDINANCE – 2ND READING

Upon motion by Esq. Allgeier and seconded by Esq. McCarty, it is ordered by the Court to approve the 2nd reading of the Non-Exclusive Dumpster Ordinance.

Motion carried unanimously.

RE: NEW BUSINESS:

RE: PLANNING & ZONING – DOCKET # 04-05-0015A

Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court to disapprove the recommendation of the Planning & Zoning Board for Docket #04-05-0015A and to allow the Zone Change from an A-1 to an A-2.

No – 2 – Brown, McCarty
Motion carried.

RE: BOARD OF ADJUSTMENTS - APPOINTMENT OF ROBBIE JAEHNIGAN

Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court to appoint Robbie Jaehnigan to serve on the Board of Adjustments.

Motion carried unanimously.

RE: SOLID WASTE UPDATE

Esq. Fisher suggested the County sponsor a tire amnesty clean up. This possibility will be looked into and discussed at a later date. No motion made.

RE: CLAIMS AND TRANSFERS

Upon motion by Esq. Fisher and seconded by Esq. Allgeier, it is ordered by the Court to approve the following Claims and Transfers:

ROAD & BRIDGE  $ 42,444.84
JAIL $49,052.39
REVOLVING LOAN  $511.86
SOLID WASTE  $1,768.27
911 EMS FUND  $5,135.10
FAIR FUND  $1,005.94

RE: COURT COMMENTS

Judge Executive Brent informed the Court that Juanita Lashley, Henry County Clerk had presented the Court with a check in the amount of $16,326.13 for Excess Fees for 2004. Mr. Moore the attorney representing Hedges and In-N-Out Dumpster Services expressed his concerns to the Court regarding the Non-Exclusive Dumpster Ordinance and Agreement. Esq. Gunnell gave an update on the Henry County Website.

RE: ADJOURN

Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.

Motion carried unanimously.
