HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
MAY 17, 2005

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a regular session on May 17, 2005 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE

Judge Executive John Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER AND PREPARATION

Silent prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Executive John L. Brent called the meeting to order and noted everyone was present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Allgeier and seconded by Esq. Brown, it is ordered by the Court to approve the minutes from the April 19, 2005 regular meeting.

Motion carried unanimously

Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to approve the minutes from the April 28, 2005 Special Budget Meeting.

Motion carried unanimously

RE: OLD BUSINESS

There being no old business the meeting proceeded into new business.

RE: NEW BUSINESS

RE: ROAD DEPARTMENT UPDATE/ADVERTISE FOR HOT MIX, COLD MIX, PRIMER, ASPHALT LAID BY THE TON, AND ROCK

Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to authorize Judge Executive, John L. Brent to advertise for bids for rock, hot and cold mix toppings, Primer, and liquid asphalt with sealed bids to be opened at 6:00 p.m. at the June 21, 2005 meeting of Fiscal Court.

Motion carried unanimously

RE: EMS UPDATE/EMS ADVISORY BOARD RECOMMENDATION

Upon motion by Esq. Gunnell and seconded by Esq. Brown, it is ordered by the Court to go to a 24/7 paid ambulance service beginning July 1, 2005 for a probation period of one year, and then access the status of the program. The 24/7 service will have one full- time paid ambulance at night, all back up ambulances will be staffed by volunteers. The volunteer squad that makes the run will receive reimbursement on an on call or per diem basis. The insurance recovery will go to the squad that makes the run.

Motion carried unanimously

Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court to hire Ryan J. Smith and Shawn Doty as part-time EMT’s.

RE: 911 REQUEST

Requests for radios from Pleasureville EMS and the Pleasureville Fire Department were tabled until next month’s meeting.

RE: PLANNING & ZONING RECOMMENDATIONS

Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the Court to accept the Planning & Zoning recommendations for a Zone Change from A-1 to B-2 for the Commerce Park Property located at Carrollton Road, Hwy. 55, Campbellsburg.

Motion carried unanimously

Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to accept the Planning and Zoning recommendations for a Zone Change from A-1 to I-1 for the Commerce Park Property located at Carrollton Road, Hwy. 55, Campbellsburg.

Motion carried unanimously

Upon motion by Esq. Allgeier and seconded by Esq. McCarty, it is ordered by the Court to accept the Planning and Zoning recommendations for a Zone Change from A-1 to A-2 at the Pait property located at 5720 LaGrange, Rd.

Motion carried unanimously

RE: COURTHOUSE PAINTING – MELISSA BEATTY

Melissa Beatty, involved citizen and accomplished artist presented the Fiscal Court with a painting of the Henry County Courthouse. The painting will be put on permanent display at the courthouse.

RE: APPOINTMENT OF COMMITTEE TO WORK WITH KHS

Esq. Gunnell and Esq. Fisher volunteered to serve on a committee to work with the Kentucky Humane Society.

RE: APPOINTMENT OF COMMITTEE FOR $1.00 HUD HOME

Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to allow committee volunteers Esq. Brown, Esq. Allgeier, and Judge Brent to make the decision on selling the HUD Property.

Motion carried unanimously

RE: KACO INSURANCE PRESENTATION – LARRY DENNY

Upon motion by Esq. Gunnell and seconded by Esq. Allgeier, it is ordered by the Court to approve KACO’s quote for the 2005-2006 All Lines Fund Premium of $99,310.00 and Worker’s Comp Premium of $53,408.00.

Motion carried unanimously

RE: LGEA HEARING

The LGEA Public Hearing was held and there were no comments from the public.

RE: CRA HEARING

The County Road Aid Hearing was held and there were no comments from the public.

RE: BOARD OF ELECTIONS MEMORANDUM OF AGREEMENT

Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court to allow Judge Executive John Brent to sign the Memorandum of Agreement with the State Board of Elections.

Motion carried unanimously

RE: ONGOING LITIGATION-MOVE INTO EXECUTIVE SESSION

Upon motion by Esq. Allgeier and seconded by Esq. Gunnell, it is ordered by the Court to enter into Executive Session to discuss ongoing litigation.

Motion carried unanimously

RE: MOVE OUT OF EXECUTIVE SESSION

Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to move out of Executive Session.

Motion carried unanimously

RE: MOTION TO RESUME REGULAR SESSION

Upon motion by Esq. Beasley and seconded by Esq. Brown, it is ordered by the Court to go into regular session.

Motion carried unanimously

RE: CLAIMS AND TRANSFERS

Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court to approve the following claims:

ROAD & BRIDGE  $ 33,962.38
JAIL FUND $ 50,912.20
FEDERAL GRANT FUND $ 22.00
SOLID WASTE  $ 555.477
L.G.E.A. FUND $ 2,942.00
911 EMS FUND $ 1,362.50
FAIR FUND  $ 829.22

TOTAL CLAIMS

$256,249.27

RE: COURT COMMENTS

Henry County Fiscal Court will hold their next regular meeting on June 21, 2005 at the Henry County 4-H Building located at the Henry County Fairgrounds.

RE: ADJOURN

Upon motion by Esq. Gunnell and seconded by Esq. McCarty, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive, and the County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
