The Henry County Fiscal Court met in regular session on August 16, 2005 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE
Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.
RE: PRAYER AND PREPARATION
Silent prayer was observed in preparation for the meeting.
RE: CALL TO ORDER
Judge Executive John L. Brent called the meeting to order and noted everyone was present.
RE: APPROVAL OF MINUTES
Upon motion by Esq. Allgeier and seconded by Esq. Fisher, it is ordered by the Court to approve the minutes from the July 12, 2005 regular meeting.

RE: OLD BUSINESS
RE: MASK AND HOOD ORDINANCE - SECOND READING
Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court to approve the second reading of the Mask and Hood Ordinance with the following amendments:
Section 3. Exemptions: (1) Amend from sixteen to thirteen years of age, Section 4. Penalties: amend from 60 to 30 days county jail time.

RE: NEW BUSINESS
RE: ROAD UPDATE
1. Resolution on County Road Aid Bond Fund Agreement with State
Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to approve the Resolution of a County Road Aid Bond Fund Agreement from the State.
Motion carried unanimously
2. 25 MPH Speed Limit on Batts Lane
Upon motion by Esq. Fisher and seconded by Esq. Allgeier, it is ordered by the Court to lower the Speed Limit on Batts Lane to 25 MPH.
Motion carried unanimously
RE: EMS UPDATE
1. Request for adding one Full – Time Employee
Upon motion by Esq. Gunnell and seconded by Esq. Brown, it is ordered by the Court to hire one full – time EMS employee with the EMS Committee making final approval.
Motion carried unanimously
2. Part – Time employee approval
Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to approve the hiring of part – time employee Thomas Clark Sampson, III.

RE: 911 REQUESTS – KY RIVER FIRE DEPARTMENT/2 RADIOS
Upon motion by Esq. Fisher and seconded by Esq. Allgeier, it is ordered by the Court to purchase 2 radios in the amount of $1,047.50 for the KY River Fire Department.
Motion carried unanimously
RE: PLANNING AND ZONING RECOMMENDATIONS
Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the Court to accept the Planning and Zoning recommendation on the proposed zoning map amendment for applicant Ron Chadwell, property located at 39 Boyer Lane, Campbellsburg, KY.

RE: AG DISTRICT RECOMMENDATIONS–RAYMER & FITZGERALD
Upon motion by Esq. Allgeier and seconded by Esq. Fisher, it is ordered by the Court to make the Ag District Recommendations to Soil Conservation Board for the Raymer Farm on McCoun RD, Smithfield, KY and the Fitzgerald Farm on Jackson RD, Eminence, KY.

RE: VOTE AMERICA – COUNTY CLERK JUANITA LASHLEY
Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the Court to accept the recommendation from Co. Clerk, Juanita Lashley to go with Harp Enterprises, for the mandated upgrade and purchase of voting machines at a total cost of $115,314.00. The State will reimburse the County 100% of this expense.

RE: LAKE JERICHO FIRE DEPARTMENT TO ADDRESS THE COURT
Guy Coombs, Fire Chief for the Lake Jericho Fire Department asked the Court for advice and assistance on how to obtain funding to build a firehouse. He stated they have saved $42,000.00 towards the purchase of the land. After much discussion Judge Brent appointed a Committee of Esq. Beasley, Esq. Allgeier, and Esq. Brown to work with the fire department to look for options. Esq. Allgeier will chair the committee.
RE: COCA COLA CONTRACT FOR PARK – 5 YEARS
SCOREBOARD ASSISTANCE
Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the Court to enter a 5 year contract with Coke which states we will only sell coke products at Harry Hill Park, the Henry County Courthouse and the EMS facilities, and in return Coke will pay $7,200.00 for the purchase of two scoreboards for use at Harry Hill Park.

RE: CAMPBELLSBURG COMMERCE PARK – PHASE II SURVEYING AND ENGINEERING WORK
Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court to allow the Committee which consists of Judge Brent, Esq. Gunnell, and Esq. Brown to fund Phase II of the Campbellsburg Commerce Park, giving Committee authority to complete all future necessary engineering and surveying work as well as purchase a sign as long as it does not exhaust the Federal Grant Fund account of $16,000.00.

RE: STATE AREA DEVELOPMENT FUND – PROJECT ASSIGNMENT FOR 2005-2006
Upon motion by Esq. Brown and seconded by Esq. Fisher, it is ordered by the Court to designate the annual ADF Grant in the amount of $9,639.99 to go towards the proposed Henry County Senior’s Center.

RE: HEALTH DEPARTMENT BUDGET & TAX RATE 2005-2006
Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court to approve the Henry County Health Department’s Budget and their tax rate of 4.0 cents per hundred dollars of the assessed valuation of all real property, personal property, and motor vehicles for Fiscal Year 2005-2006.

RE: APPROVAL OF 2004-2005 TREASURER’S SETTLEMENT
Upon motion by Esq. Beasley and seconded by Esq. McCarty, it is ordered by the Court to approve the 2004-2005 Treasurer’s Settlement.

RE: SETTING OF TAX RATES FOR 2005
Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court that the County tax levy be fixed at 11.9 per hundred dollars on all vehicles and watercraft for 2005. A public hearing for the tax levy will be held on September 13, 2005 at 6:00 P.M. This is the same rate as 2004.

Upon motion by Esq. Brown and seconded by Esq. Fisher, it is ordered by the Court that the County tax levy be fixed at 11.7 per hundred dollars on all real property in Henry County, KY. A public hearing for the tax levy will be held on September 13, 2005 at 6:00 P.M. This is the same rate as 2004.

Upon motion by Esq. Allgeier and seconded by Esq. Gunnell, it is ordered by the Court that the County tax levy be fixed at 15.9 per hundred dollars on all personal property. A public hearing for the tax levy will be held on September 13, 2005 at 6:00 P.M. This is the same rate as 2004.

RE: FISCAL COURT ENDORSEMENT OF COUNTY DISASTER DECLARATION
Upon motion by Esq. Fisher and seconded by Esq. Beasley, it is ordered by the Court to endorse the County Disaster Declaration on the Drought.

RE: CHANGE OF SEPTEMBER FISCAL COURT MEETING
Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court to meet for the regular September Fiscal Court Meeting on September 13, 2005 at 6:00 P.M. This change is necessary to hold the public hearing for the tax levy.

RE: CLAIMS AND TRANSFERS
Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the Court to approve the following claims:

RE: COURT COMMENTS
Esq. Gunnell noted $25,000.00 has been spent on legal fees for the Garbage Ordinance Lawsuit against the County. He stated these funds could be used for projects to benefit our Parks, Senior Citizens, and EMS.
Judge Brent announced a Solid Waste Workshop would be held at Cumberland Falls on September 15th and 16th and Henry County will be receiving an award for cleanup. He also noted KY HWY 146 was let on July 27th and there will be a groundbreaking ceremony next month.
Esq. Gunnell thanked the road department and road supervisor Glenn Baxter on the blacktopping job on Hensley Lane.
Esq. Gunnell thanked the following sponsors for their support and noted the monetary contributions in purchasing the scoreboards at Harry Hill Park:

Upon motion by Esq. Allgeier and seconded by Esq. Gunnell, it is ordered by the Court to Adjourn and each Magistrate, the Judge Executive and County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting..
