HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
SEPTEMBER 13, 2005

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in regular session on September 13, 2005 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE

Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER AND PREPARATION

Silent prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Executive John L. Brent called the meeting to order and noted everyone was present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court to approve the minutes from the August 16, 2005 regular meeting.

Motion carried unanimously

RE: OLD BUSINESS

RE: SECOND READING AND PUBLIC HEARING – TAX RATES 2005

Judge Brent opened the meeting to take public comments concerning the 2005 tax rates. Their being no comments from the public the Court proceeded with old business.

Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court that the County tax levy be fixed at 11.7 cents per hundred dollars on all real property in Henry County, Kentucky. This is the same rate as 2004.

Motion carried unanimously

Upon motion by Esq. Allgeier and seconded by Esq. Brown, it is ordered by the Court that the County tax levy be fixed at 11.9 cents per hundred dollars on all vehicles and watercraft in Henry County, Kentucky. This is the same rate as 2004.

Motion carried unanimously

Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the Court that the County tax levy be fixed at 15.9 cents per hundred dollars on all personal property in Henry County, Kentucky. This is the same rate as 2004.

Motion carried unanimously

RE: NEW BUSINESS

RE: ROAD UPDATE

Judge Brent gave an update on state roads that had been paved. He noted Hwy 1360 near the Franklinton Bridge was complete and work should begin on Hwy 153 anytime. The groundbreaking on Hwy 146 went great and they have already started moving dirt.

Glenn Baxter, Henry County Road Supervisor noted the County had two more days of blacktopping. Among the roads Mago will blacktop this fall are Giltner Road and Lead Mine. Some roads will probably not be paved until spring. The work on Mt. Gilead is complete and work will begin on Flat Rock Road. Esq. Beasley discussed his concerns with the road slipping on Union Church Road. Judge Brent asked Esq. Beasley and Glenn to bring their recommendations back to the Court at the October meeting.

1. Establishment of 25 M.P.H. speed limit in Rose Hill Estates

Upon motion by Esq. Allgeier and seconded by Esq. Fisher, it is ordered by the Court to lower the speed limit on all roads in Rose Hill Estates to 25 M.P.H.

Motion carried unanimously

2. Roads to be accepted into County System – Lost Creek and Penn Court

Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court to accept Lost Creek being .207 miles and Penn Court .105 miles into the County System. The roads are blacktopped to County specifications.

Motion carried unanimously

RE: EMS UPDATE

Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the Court to accept the recommendation to hire Glenn Ball as a full time EMT effective October 1, 2005.

RE: 1ST READING OF HAZARDOUS SUBSTANCES ORDINANCE

Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to approve the 1st reading of the Hazardous Substances Ordinance.

Motion carried unanimously

RE: 1ST READING OF SUCCESSION ORDINANCE FOR NATIONAL OR LOCAL EMERGENCIES

Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court to approve the 1st reading of the Succession Ordinance for National or Local Emergencies and in the absence of the County Judge/Executive and Deputy Judge/ Executive the duties of the Office of Judge/Executive shall be assumed temporarily by Esq. Gunnell.

Motion carried unanimously

RE: BID OPENING FOR VOTING MACHINES COMPLIANT WITH “VOTE AMERICA ACT”

Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court to accept the only bid received, Harp Enterprises, Inc. in the amount of $120,155.00. The State will reimburse the County 100% of this cost.

RE: FAIRGROUNDS ARENA BUILDING

Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to establish a committee of Judge Brent, Esq. Beasley and Esq. McCarty to work with the existing Community Committee which has been working on the project for a year. In addition to authorize the Court Committee to tear down the tie-stall barn, move dirt, advertise specs, the letting of bids, and permission to work with electrician and architect if necessary, as long as it does not exceed the amount in the fairground account earmarked for this project. The Court will continue to pursue acquiring more land contiguous to the fairgrounds. Members of the Citizen Committee Larry Congleton, Keith Jeffries, and David Neville were in attendance to answer questions.

RE: STATEWIDE SURVEY ON COSTS OF COUNTY JAIL SYSTEMS

Judge Brent discussed a survey complied by the Kentucky Judge Executive’s Association which shows only 7 out of 119 county jails are operating in the black. He noted most jails that house our inmates lost a greater amount of money than we paid for our inmates housing. Shelby County is paying 6 million dollars for 100 new beds. Judge Brent felt this shows even though we are struggling with the cost of housing inmates this is the most efficient use of the tax- payers dollars.

RE: CLAIMS AND TRANSFERS

Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to approve the following claims and transfers:

GENERAL FUND  $ 167,560.42
ROAD & BRIDGE  $ 103,605.13
JAIL FUND $ 36,195.68
SOLID WASTE  $ 1,206.75
911 EMS FUND $ 16,591.79
FAIR FUND  $ 3,743.23

TOTAL CLAIMS

$328,903.00

RE: COURT COMMENTS

Deputy Judge Bryant gave an update on the FEMA Projects concerning our bridges.

RE: ADJOURN

Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
