HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
FEBRUARY 21, 2006

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a regular session on February 21, 2006 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE

Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER & PREPARATION

Silent prayer was observed in preparation for the meeting

RE: CALL TO ORDER

Judge Executive John L. Brent called the meeting to order and noted everyone was present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to approve the minutes from the January 17, 2006 regular meeting.

Motion carried unanimously

RE: OLD BUSINESS

There being no Old Business, the meeting proceeded with New Business.

RE: NEW BUSINESS

RE: ROAD DEPARTMENT

1. Supervisor Update – Henry County Road Supervisor, Glenn Baxter reported Hance’s Bridge on Six-Mile has been removed and the Cast of the new bridge will take about 30 days. The project of replacing the bridge will start in early spring. He also noted the shed to store salt is complete except the asphalt for the floor. Glenn reported he could get salt if needed.

2. Filling Vacant Positions – Glenn Baxter ask the Court to hire 2 currently part-time road employees for full- time positions. One position will replace Curtis Higgins who recently resigned, and the other position will allow the road department to be fully staffed as in prior years with 8 full-time employees.

Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to hire two full time road department employees with one beginning employment on February 27th and the other will start on April 3.

3. Resolution on Legislative Bond Appropriations- Judge Brent read a resolution he had drafted to go to Frankfort thanking the Governor and State Legislature for the 2005 State Bond Appropriation for County Road Improvements and asking for their support for the State Bond Appropriation for County Road Improvements in the 2006 budget. Judge Brent noted that the County had received approximately $360,000 and this money was used to help in paving 21 miles of road last year.

Upon motion by Esq. Fisher and seconded by Esq. McCarty, it is ordered by the Court to adopt the Resolution on Legislative Bond Appropriations.

Motion carried unanimously

4. County Road Map Adoption- The Transportation Cabinet asked Adam Forsythe with KIPDA to present a draft of the County Road Map to the Court. Adam asked the Court to review the draft and make necessary changes. The Court will finalize the County Road Map at the March meeting.

RE: EMS

1. Supervisors Update – Scott McClamroch, Interim EMS Supervisor asked the Court for approval to hire part-time employees David Noe and Ed Whitaker.

Upon motion by Esq. Beasley and seconded by Esq. Allgeier, it is ordered by the Court to hire David Noe and Ed Whitaker has part-time EMT’S.

Motion carried unanimously

2. Supervisor’s Position

Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court to allow the EMS Committee to interview for a new EMS Supervisor with a salary range of $24,000 to $29,000 and to look at candidates for Assistant EMS Supervisor at the current salary of $22,000.

RE: PLANNING & ZONING – 1ST READING OF PROPOSED ZONING AMENDMENT

Commissioner Josh Clubb addressed the Court. He reviewed the Planning & Zoning recommendations to amend the Zoning Ordinance. He answered questions from the Court and the public.

Henry County PVA, Jason Scriber gave an informative discussion of the importance of obtaining building permits before starting a structure. He stated it is the responsibility of all taxpayers to notify his office of any improvements to their property. He also answered questions from the Court and the public.

Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to approve the 1st reading of the Planning and Zoning Ordinance Amendment which clarifies Section 770; which states who is entitled to the two cuts from the track of land.

Motion carried unanimously

Upon motion by Esq. McCarty to approve the 1st reading of the Planning and Zoning Ordinance Amendment which clarifies Sections 250 & 260 which states (l) All Ag buildings are required to get building permits (2) No fees for permits for Ag buildings.

Motion died for lack of a second

RE: CDBG MONEY DESIGNATIONS FOR COUNTY COMMERCE PARK

Upon motion by Esq. Fisher and seconded by Esq. Allgeier, it is ordered by the Court to allow the Commerce Park Committee to spend the remaining funds of approximately $16,000 left in the CDBG account for the County Commerce Park for purposes of infrastructure improvement and sign purchase.

Motion carried unanimously

RE: EMERGENCY SERVICES IDENTIFICATION BADGES – HOMER DRUIN TO ADDRESS THE COURT

Homer Druin came before the Court to discuss the importance and need for identification badges for all emergency personnel and first responders. Homer ask the Court to form a Committee to work with him to look at the cost, guidelines, and who is responsible to issue the badges. Esq. Allgeier and Esq. Beasley volunteered to serve on the Committee. They will bring there recommendations back to the Court at next month’s meeting.

RE: HENRY COUNTY WATER DISTRICT BOARD APPOINTMENT – RECOMMENDATION OF JERRY POWELL TO BE REAPPOINTED

Upon motion by Esq. McCarty and seconded by Esq. Brown, it is ordered by the Court to accept the recommendation of the Henry County Water District Board for the reappointment of Jerry Powell.

Motion carried unanimously

RE: RESOLUTION ENDORSING HB 274 (PERTAINS TO STATE TAKE OVER OF COUNTY JAILS)

Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the Court to adopt the Resolution Endorsing HB 274, which pertains to the state takeover of County Jails.

Motion carried unanimously

RE: HENRY COUNTY CLERK’S REPORT – JUANITA LASHLEY TO ADDRESS THE COURT

Henry County Clerk, Juanita Lashley presented the Court a check in the amount of $31,553.54 for excess fees.

RE: HENRY COUNTY SHERIFF’S REPORT – G. R. “BOBBY” DOWNEY TO ADDRESS THE COURT

Henry County Sheriff, G. R. “Bobby” Downey came before the Court to present his excess fee check in the amount of $100,857.02. Sheriff Downey requested the Court to allow for the purchase of a new cruiser in next year’s budget.

Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to approve
the following claims and transfers:

RE: COURT COMMENTS

Judge Brent thanked Henry County PVA, Jason Scriber, Henry County Clerk, Juanita Lashley, and Henry County Sheriff, G. R. “Bobby” Downey for attending the meeting. He stated how fortunate the County is to have these elected officials running their offices in a efficient and financially sound manner.

RE: ADJOURN

Upon motion by Esq. Gunnell and seconded by Esq. Allgeier, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
