The Henry County Fiscal Court met in a regular session on July 18, 2006 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE
Judge Executive John Brent led the Court in the Pledge of Allegiance to the Flag.
RE: PRAYER & PREPARATION
Silent prayer was observed in preparation for the meeting.
RE: CALL TO ORDER
Judge Brent called the meeting to order and noted Esq. Brown would be absent for a period of time due to Military Duty. Judge Brent stated there are no provisions to replace Esq. Brown and as an elected official he will still draw his salary, this according to authorities at the state level.
RE: APPROVAL OF MINUTES
Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court to approve the minutes from the June 20, 2006 Regular Meeting.

Upon motion by Esq. Beasley and seconded by Esq. McCarty, it is ordered by the Court to approve the minutes from the June 27, 2006 Special Meeting.

RE: OLD BUSINESS
There being no Old Business, the meeting proceeded with New Business.
RE: NEW BUSINESS
RE: ROAD DEPARTMENT UPDATE
Glenn Baxter, Henry County Road Supervisor, informed the Court that the road department has started blacktopping, but due to the heat only for half of the day. Glenn noted the projected prices for blacktop were higher than expected, but he didn’t propose cutting any of the projects. Judge Brent noted a carryover from the previous year could be amended into the budget if needed. Glenn stated Cane Run might be blacktopped instead of Lake Road, due to the sewer project. Esq. Beasley asked that a hole be repaired on Watkins Lane.
RE: EMS UPDATE
Henry County EMS Supervisor, Scott McClamroch, stated the 24/7 EMS has been in operation for one year and it has been a total success. He noted it is breaking even financially. Scott noted he has one full-time EMT that will be going on Maternity Leave and he recommended the Court hire C. Michael Marowelli, Lenton V. Woolley, Jr., and Paul D. McDonald, as part-time EMT’S. Judge Brent noted the County does not pay Maternity Leave. An employee may use accrued sick leave and annual leave, or be placed on unpaid medical leave.
Upon motion by Esq. Gunnell and seconded by Esq. Allgeier, it is ordered by the Court to hire C. Michael Marowelli, Lenton V. Woolley, Jr., and Paul D. McDonald, as part-time EMT’S.

RE: 911 REQUEST – PLEASUREVILLE EMS
Upon motion by Esq. Beasley and seconded by Esq. Gunnell, it is ordered by the Court to purchase two (2) radios for the Pleasureville EMS for a total price of $1047.00.

RE: PLANNING & ZONING & SOLID WASTE
Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court to accept the resignation of Bill Brammell, the Attorney for P&Z and Board of Adjustments, and to appoint, Josh Clubb, as the designee for the Brammell Law Firm, which will continue to provide legal services.
RE: RESIGNATIONS-WILLIAM PEYTON-PLANNING & ZONING ADMINISTRATOR/SOLID WASTE COORDINATOR AND STEVE HEFFLEY-SOLID WASTE CODE ENFORCEMENT OFFICER
Judge Brent informed the Court that William Peyton, Planning & Zoning Administrator/Solid Waste Coordinator and Steve Heffley, Solid Waste Code Enforcement Officer, have resigned their positions. Both have agreed to stay, for a reasonable period of time, until their positions can be filled. Judge Brent asked the Court to establish a hiring committee and to set a salary range for the Planning and Zoning Position. Esq. Gunnell and Esq. Beasley will serve on the hiring committee.
Upon motion by Esq. Gunnell and seconded by Esq. McCarty, it is ordered by the Court to set the Planning & Zoning Administrator/Solid Waste Coordinator’s Salary at a minimum of $25,500.00 and a maximum of $28,000.00

Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court to accept the Planning & Zoning recommendation for a Zone Change from A-1 to A-2 for the Kemper property located at 835 Union Church Road.

RE: PARKS & COURTHOUSE/ANNEX PERSONNEL PROPOSAL
Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court to approve three personnel changes. William Peyton, will become the Parks Coordinator at an annual salary of $22,600. Steve Heffley, will work part-time as an assistant to the parks coordinator, at an annual salary of $10,000, and Bobby Robinson at his current salary, will become the Courthouse and Annex Superintendent.

RE: ANTI-DISPLACEMENT RESOLUTION PERTAINING TO SENIORS CENTER PROJECT
Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court to pass the Anti-Displacement Resolution, which pertains to, the seniors center project.

RE: COST OVERRUN RESOLUTION PERTAINING TO THE SENIORS CENTER PROJECT
Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court to approve the Cost Overrun Resolution pertaining to the seniors center project.

RE: RESOLUTION PERTAINING TO THE FUNDING FOR THE LAKE JERICHO FIRE DEPARTMENT
Upon motion by Esq. Allgeier and seconded by Esq., Beasley, it is ordered by the Court to approve the Resolution pertaining to the funding for the Lake Jericho Fire Department.

RE: RESOLUTION OF THE H.C. PUBLIC HEALTH TAX RATE FOR 2006
Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court to accept the Resolution as set by the Henry County Board of Health for the Henry County Health Tax Rate for the year of 2006.

RE: HENRY COUNTY COMMUNITY CORRECTIONS FINANCIAL SETTLEMENT
Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court to forward the grant balance of $7,707.91 in the Henry County Community Corrections account to the State Department of Corrections.

RE: APPROVAL OF 2005-2006 TREASURER’S SETTLEMENT
Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court to approve the 2005-2006 Treasurer’s Settlement.

RE: IN-KIND SPONSORSHIP OF HENRY COUNTY HARVEST SHOWCASE
Upon motion by Esq. Fisher and seconded by Esq. Beasley, it is ordered by the Court to be an in-kind sponsor of the Henry County Harvest Showcase, as the Showcase is held at the Henry County Fairgrounds.

RE: COURT COMMENTS
Esq. Gunnell expressed his desire for Henry County EMS to have full time paramedic services. He noted Henry County was one of six counties in the State that does not have full time paramedics. He suggested the Court allow a feasibility study of this issue.
Upon motion by Esq. Gunnell and seconded by Esq. Allgeier, is it ordered by the Court to allow the EMS Committee and EMS Advisory Board to do a feasibility study and to bring the results back to the Court at the December 2006 meeting.

Esq. Fisher presented a petition to the Court from the Lockport Community concerning the restructure of two curves on Lead Mine Road. Esq. Fisher and Esq. Allgeier will review the road and give their recommendation of the cost estimate and plan to the Court at the August meeting.

Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
