HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
AUGUST 15, 2006

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a regular session on August 15, 2006 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE

Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER & PREPARATION

Silent prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Executive John L. Brent called the meeting to order and noted everyone was present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court that the minutes from the July 18, 2006 regular meeting shall be approved with the amendment to read accepting Bill Brammell’s recommendation that he be allowed to step aside and that the Court allow Josh Clubb of the Brammell Law Firm, to continue to provide legal services for Planning and Zoning and the Board of Adjustments.

RE: OLD BUSINESS

RE: LEADMINE ROAD – COMMITTEE REPORT ON WIDENING

Esq. Fisher came before the Court with a recommendation to widen the bottom curves on Lead Mine Road. Esq. Fisher presented a bid of four thousand eight hundred dollars ($4,800.00) from Bowen Excavating. This would allow a safe exit out of Lockport in case of flooding. He noted the County Road Department would be needed to blacktop following the completed work. Glenn Baxter, Henry County Road Supervisor, stated the County Road Department could do only one side of the road, not the rock side, and a backhoe would be needed to widen the rock ledge.

Upon motion by Esq. Fisher and seconded by Esq. Allgeier, it is ordered by the Court to allocate $4800.00 to widen the curves on Lead Mine Road.

RE: NEW BUSINESS

RE: ROAD UPDATE

1. Surfacing & Resurfacing Cost Projection for 2006/2007

Glenn Baxter, Henry County Road Supervisor, reported the cost associated with blacktopping. He noted a cost increase of twenty-five percent (25%) on asphalt post budget. Despite this the budget was only out by approximately twenty-six thousand dollars ($26,000.00). Judge Brent stated this could be moved from reserve for transfer and a budget amendment if needed.

Glenn gave the Court an update on the blacktopping, noting twenty-five percent (25%) of the projects have been completed and if the weather permits all projects will be completed before cold weather. Esq. Gunnell suggested the road department be given comp time to work laying blacktop on Fridays. Glenn stated it was not necessary at this time, but they could re-evaluate this suggestion if needed.

2. Establish speed limits on Lower Bowling Road & Savannah Acres

Upon motion by Esq. Fisher and seconded by Esq. Allgeier, it is ordered by the Court to table the decision to establish a 25 mph speed limit on Lower Bowling Road as a “Children at Play” sign may be all that is needed.

Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court to establish a 15 mph speed limit on Savannah Acres.

RE: EMS UPDATE

Esq. Gunnell reported on behalf of the EMS Committee that they would like to see more Henry County residents hired and given more hours in the EMT positions. Scott McClamroch, Henry County EMS Supervisor, was in agreement and stated he gives preference to Henry County Applicants but no one is certified at this time.

1. Part-time Hiring Recommendations

Upon motion by Esq. Gunnell and seconded by Esq. Brown, it is ordered by the Court to approve the hiring of Mark Rexroat and Angela Auberry as part-time EMT’s.

2. EMS Advisory Committee Recommendation on Paramedic Program

Patrick Burnett with the EMS Advisory Committee came before the Court with comments and an update on the plan for implementing the Paramedic Program.

Patrick noted that they are working with Dr. Rochet on protocols and licensing applications. The EMS Advisory Committee will give an update to the Court at each meeting and hopes to present a three-year tier plan to the Court at the November meeting.

Esq. Gunnell stated it is all about numbers and money and they hope to have the feasibility study by the November meeting and pending protocols and licensing applications to begin the paramedic program January 1, 2007. No action taken.

RE: 911 COMMITTEE RECOMMENDATIONS

Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to purchase a portable two-way radio for the City of Campbellsburg.

RE: PLANNING & ZONING – COMMITTEE UPDATE ON FILLING THE ADMINISTRATOR’S POSITION

Judge Brent gave an update to the Court on filling the Planning and Zoning Administrator’s position. He noted the second round of interviews will be done this week, and he will call a Special Meeting for Court approval.

RE: AREA DEVELOPMENT FUND (STATE GRANT) COUNTY PROJECT FOR 2006/2007

Upon motion by Esq. McCarty and seconded by Esq. Fisher, it is ordered by the Court to apply this year’s ADF funds towards the continued work on the Pavilion located at the fairgrounds.

Motion carried unanimously

RE: CARROLL COUNTY JAIL CONTRACT APPROVAL

Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to approve the 3% increase or a rate of $30.90 per day contract with the Carroll County Jail.

Motion carried unanimously

RE: SETTING OF THE 2006/2007 COUNTY TAX RATES

Upon motion by Esq. Brown and seconded by Esq. Fisher, it is ordered by the Court that the County tax levy be fixed at 11.7 per hundred dollars on all real property in Henry County, KY. A public hearing for the tax levy will be held on September 19, 2006 at 6:00 P.M. This is the same rate as 2005.

Motion carried unanimously

Upon motion by Esq. McCarty and seconded by Esq. Allgeier, it is ordered by the Court that the County tax levy be fixed at 15.9 per hundred dollars on all personal property in Henry County, KY. A public hearing for the tax levy will be held on September 19, 2006 at 6:00 P.M. This is the same rate as 2005.

Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court that the County tax levy be fixed at 11.9 per hundred dollars on all vehicles and watercraft for 2006. A public hearing for the tax levy will be held on September 19, 2006 at 6:00 P.M.

This is the same rate as 2005.

RE: CLAIMS & TRANSFERS

Upon motion by Esq. Gunnell and seconded by Esq. Allgeier, it is ordered by the Court to approve the following claims and Transfers:

JAIL FUND $ 36,428.56
L.G.E.A. FUND $ 2,221.97
911 EMS FUND $ 1,604.50
FEDERAL GRANT FUND $ 45.00
FAIR FUND  $ 2,197.33

TOTAL EXPENDITURES

$319,758.61

RE: COURT COMMENTS

Henry County Attorney, Virginia Harrod, asked the Court for permission to spruce up the old jail area at the back entrance to the courthouse. She volunteered to donate patio furniture and ferns to make the area more attractive. She noted it would be at no cost to the County and the area could be used as a smoke area or for the courthouse employees to enjoy their lunch break. The Court was in consensus to allow this, as long as there were no structural changes to the building.

RE: ADJOURN

Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
