HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
SEPTEMBER 19, 2006

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a Regular Session on September 19, 2006 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE

Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER & PREPARATION

Silent Prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Executive John L. Brent called the meeting to order and noted everyone was present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Brown and seconded by Esq. Allgeier, it is ordered by the Court to approve the minutes from the August 24, 2006 Special Meeting.

Motion carried unanimously

Upon motion by Esq. McCarty and seconded by Esq. Gunnell, it is ordered by the Court to approve the minutes from the September 7, 2006 Special Meeting.

Motion carried unanimously

Upon motion by Esq. Allgeier and seconded by Esq. Beasley, it is ordered by the Court to approve the minutes from the August 15, 2006 Regular Meeting.

RE: OLD BUSINESS

RE: SECOND READING AND PUBLIC HEARING – 2006/2007 TAX RATES

Judge Brent opened the meeting to take public comments concerning the 2006-2007 tax rates. Their being no comments from the public the Court proceeded with old business.

A. Real Property

Upon motion by Esq. Gunnell and seconded by Esq. Brown, it is ordered by the Court that the County tax levy be fixed at 11.7 per hundred dollars on all real property in Henry County, KY. This is the same rate as 2005.

Motion carried unanimously

B. Tangibles

Upon motion by Esq. Allgeier and seconded by Esq. Fisher, it is ordered by the Court that the County tax levy be fixed at 15.9 per hundred dollars on all personal property in Henry County, KY. This is the same rate as 2005.

Motion carried unanimously

C. Watercraft and Motor Vehicles

Upon motion by Esq. Fisher and seconded by Esq. McCarty, it is ordered by the Court that the County tax levy be fixed at 11.9 per hundred dollars on all watercraft and motor vehicles. This is the same rate as 2005.

RE: NEW BUSINESS

RE: ROADS

1. Supervisor’s Update

Henry County Road Supervisor, Glenn Baxter, informed the Court that the work on Hance’s Bridge was 60 percent (60%) completed. He noted the bridge was looking good and estimated the project will be completely finished in a month or so, depending on the weather. He also informed the Court that the road department’s new dump truck should be delivered in the next two weeks.

2. Lake Road Resurfacing

Esq. Brown informed the Court that a new sewer line would be laid from Campbellsburg to Carrollton with the line going through Lake Road. Due to the sewer project Esq. Brown suggested the Court delay resurfacing Lake Road until next year, and re-appropriate the same amount of blacktop for surfacing on Cane Run Road.

Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to re-appropriate the blacktop designated for Lake Road to blacktop a portion of Cane Run Road.

3. Giltner Road Resurfacing

Glenn Baxter expressed his concerns regarding the resurfacing of Giltner Road. He noted that Giltner Road was heavily traveled and the County Road Department did not have anyone who was certified to flag. Glenn stated the money is still in the budget so we have the financial resources to contract it, and Ohio Valley and Mago have the equipment and both are capable to do the job. Mago had given an estimate of sixteen to eighteen thousand dollars. Due to his safety concerns he recommended to the Court that Giltner Road be contracted for resurfacing.

Upon motion by Esq. Gunnell and seconded by Esq. Allgeier, it is ordered by the Court to accept the road supervisors recommendation to contract the resurfacing of Giltner Road, as long as it does not exceed twenty thousand dollars.

RE: EMS UPDATE

Patrick Burnett with the EMS Advisory Committee gave an update on the plan to implement the Paramedic Program. He noted they are working on the budget and Dr. Rochet is still working on the protocols. Patrick plans to present the budget to the Court at the November meeting.

RE: 911 REQUESTS - COMPUTER FOR ID SYSTEM

Upon motion by Esq. Beasley and seconded by Esq. Gunnell, it is ordered by the Court to table the request from the Henry County Fire Chiefs Association for a computer for the ID System, as no dollar amount was requested.

RE: PLANNING & ZONING – COMMISSIONER VACANCY

Esq. Beasley informed the Court that he is working to fill the vacancy and hopes to have a name by the October meeting.

RE: SENIORS COMMODITY PROGRAM – ADMINISTRATION COMPENSATION

Judge Brent recommended the Court compensate Donnie Tipton and Michael Arnold for their work with the Seniors Commodity Program. He noted they screen the applicants, order the commodities, and work handing the commodities out.

Upon motion by Esq. Allgeier and seconded by Esq. McCarty, it is ordered by the Court to compensate Donnie Tipton and Michael Arnold one hundred dollars ($100.00) each, per month, for their work with the Seniors Commodity Program.

RE: PROCUREMENT STANDARDS (SENIOR’S CENTER)

Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to adopt the Procurement Standards on the CDBG Project for the Henry County Senior Citizens Center.

RE: VOTING MACHINE LOCATION APPROVAL

Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to approve the request from Juanita Lashley, Henry County Clerk, to use more than one voting machine in each precinct.

RE: SPECIAL SESSION – DISCUSS PENDING LAWSUITS

RE: MOTION TO MOVE OUT OF REGULAR SESSION

Upon motion by Esq. Allgeier and seconded by Esq. Gunnell, it is ordered by the Court to move out of Regular Session.

Motion carried unanimously

RE: MOTION TO MOVE INTO EXECUTIVE SESSION

Upon motion by Esq. Brown and seconded by Esq. McCarty, it is ordered by the Court to move into Executive Session to discuss pending lawsuits.

RE: MOTION TO MOVE OUT OF EXECUTIVE SESSION

Upon motion by Esq. McCarty and seconded by Esq. Fisher, it is ordered by the Court to move out of Executive Session.

Motion carried unanimously

RE: MOTION TO MOVE BACK INTO REGULAR SESSION

Upon motion by Esq. Allgeier and seconded by Esq. Fisher, it is ordered by the Court to move back into Regular Session.

RE: CLAIMS & TRANSFERS

Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to approve the following claims and transfers:

LGEA FUND $ 2,039.10
FEDERAL GRANT FUND $ 20.00

RE: COURT COMMENTS

Scott McClamroch, Henry County EMS Director, invited the Court to attend the EMS Open House on Monday, September 25, 2006. He noted their show of support would be appreciated by the EMS.

RE: ADJOURN

Upon motion by Esq. McCarty and seconded by Esq. Beasley, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and County Attorney shall received a typed copy of these minutes prior to the next regularly scheduled meeting.
