The Henry County Fiscal Court met in a regular session on October 16, 2007 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE
Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.
RE: PRAYER & PREPARATION
Silent prayer was observed in preparation for the meeting.
RE: CALL TO ORDER
Judge Brent called the meeting to order and noted everyone was present.
RE: APPROVAL OF MINUTES
Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to approve the minutes from the September 18, 2007 regular meeting.
Motion carried unanimously
RE: OLD BUSINESS
There being no old business the meeting proceeded with new business.
RE: NEW BUSINESS
RE: ROAD UPDATE
1. Road Committee Update
Glenn Baxter reported the road committee had met to address the road adoption/closure policies. They have many unanswered questions and are getting ordinances from Planning and Zoning to help them in making good decisions. The committee will meet again in November. Glenn also informed the Court that all in house blacktopping is completed and the end of Flat Rock Road is done.
Judge Brent received word from the Governor’s Office and the Transportation Cabinet that the County was awarded $365,000.00 for road improvements. He read the letter from Ginger Wills that states Shawnee Industrial Park, New Cut, Byers Lane, Jackson Road, Lake Road, Crabb Acres, Forrest Drive, Evelyn Ridge Drive, David Drive and Sycamore Drive will be submitted in the October state letting. He noted it will most likely be next year before the roads are completed.
2. Truck Weight Limit Discussion – Giltner Road
Glenn Baxter informed the Court that state law mandates an 18 ton weight limit on county roads. He has ordered signs and will post them as soon as they come in. Esq. Gunnell suggested county attorney Virginia Harrod send letters to the KSP and DOT to request enforcement on these weight limits. It was noted that farmers where exempt.
RE: EMS/PARAMEDIC UPDATE
Judge Brent reported no new hiring requests or new reports from the EMS.
RE: 911 REQUEST- EMINENCE FIRE DEPARTMENT
Upon motion by Esq. Beasley and seconded by Esq. Gunnell, it is ordered by the Court to purchase two (2) pagers for a total price of $880.00 for the Eminence Fire Department and after the first of the year to allow an annual purchase of 3 pagers or 2 radios.
Motion carried unanimously
RE: CELL TOWER UPDATE
Judge Brent gave an update on the cell tower. He spoke with Tammy Smith of Verizon and she informed him they are still evaluating sites in the New Castle area. Virginia Harrod noted she has not heard from Verizon’s attorney.
RE: HENRY COUNTY PARK EXCAVATING CONTRACT
Judge Brent reviewed the contract with the Court. It states Barry Bowen agrees to remove clay fill dirt (not to exceed 20,000 cubic yards) from the Henry County Park and haul it to the Henry County High School. All top soil shall be left on Park property and in exchange he will build two soccer fields at no cost to the County. Esq. Hawkins noted the need to get the youth football fields done before Barry moves his equipment. Judge Brent called for a vote.
Upon motion by Esq. Hawkins and seconded by Esq. Beasley, it is ordered by the Court to enter into a contract with Barry Bowen to do excavating at the new park site.

RE: JUDGE/EXECUTIVE & SOLID WASTE VEHICLE DISCUSSION
Judge Brent informed the Court that the vehicle he and the solid waste employees use has brake problems, high mileage and the window doesn’t work. He stated the Court has the option to (a) work on the car (b) take the sheriff’s 1993 car that has air and window problems or (c) purchase a 2001 Ford Crown Victoria from the State Surplus Sale at a price of $4750.00. Judge Brent noted Solid Waste uses the car every Friday to help with traffic control for the litter cleanup. Esq. Gunnell stated he felt this car was a liability to the County. Esq. Beasley suggested the County take bids on the sheriff and judge’s vehicles and that money be put back in the budget to offset the cost of buying the 2001 Crown Vic.
Upon motion by Esq. Beasley and seconded by Esq. Hawkins, it is ordered by the Court to buy the 2001 Ford Crown Victorian at a price of $4750.00 with ½ cost coming from the Solid Waste Fund and ½ cost from the Judge/Executive/General Fund with the proceeds from the sale of the two vehicles to apply towards the purchase.

RE: COUNTY CLERK JUANITA LASHLEY
1. Voting Machine Approval
Henry County Clerk Juanita Lashley requested the Court’s approval to use more than 1 voting machine in each precinct for the upcoming November 6, 2007 General Election. She noted this is a routine request she is required to do.
Upon motion by Esq. Brown and seconded by Esq. Coombs, it is ordered by the Court to approve the use of more than one voting machine in each precinct for the November 6, 2007 General Election.

2. History Center Presentation Pertaining to County Records
Juanita Lashley asked the Court to make a yearly donation of $750.00 to the Henry County History Center. She noted they have many of the County’s older records and are doing a fantastic job in preserving them. She presented financial reports which included office supplies needed to house these early records.
Upon motion by Esq. Fisher and seconded by Esq. Brown, it is ordered by the Court to approve a one- time donation of $750.00 to the Henry County History Center and it is to be reviewed on an annual basis.

RE: AG DISTRICT RECOMMENDATION – THARP & KLEINERT FARMS
Upon motion by Esq. Brown and seconded by Esq. Coombs, it is ordered by the Court to accept the Henry County Ag
District recommendation to amend Ag District #052-10 to
include A-3 for the Ray Tharp and Tori Kleinert farms.
Motion carried unanimously
RE: OLDHAM COUNTY AIRPORT UPDATE
Judge Brent informed the Court that a meeting of the Oldham County Fiscal Court will be held on October 24, 2007 at 2:30 p.m. to determine the site of the Oldham County Airport.

RE: COURT COMMENTS
Esq. Brown and Esq. Gunnell complimented the EMS Service on being under budget and on a job well done. Virginia Harrod reviewed a report of Henry County’s Comparative Assessment of Health Risk and noted Henry County had done well ranking 26 out of 120 counties. Ms. Harrod also gave good news that Henry County prevailed in the Hillz and Hallorz Lawsuit.

Upon motion by Esq. Hawkins and seconded by Esq. Fisher, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and the County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
