HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
APRIL 17, 2007

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a regular session on April 17, 2007 at the Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE

Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER & PREPARATION

Silent prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Executive John L. Brent called the meeting to order and noted everyone was present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Brown and seconded by Esq. Hawkins, it is ordered by the Court to approve the Minutes from the March 20, 2007 regular meeting.

Motion carried unanimously

RE: OLD BUSINESS

Their being no Old Business, the meeting proceeded with New Business.

RE: NEW BUSINESS

RE: ROAD UPDATE

Judge Brent discussed the road proposals with the Court. He reviewed the breakdown per district noting all requested projects were included in the 2007/2008 Budget with the exception of Lake Road. Pending the condition of Lake Road after completion of the new sewer line it may need work at a later time. Glenn Baxter, Henry County Road Supervisor, noted he would like to see the Court develop a formula for future years that would divide the road money in a fairer way and help aid the County in preparing the budget. Some districts have many more miles of county roads than other districts. Esq. Hawkins suggested using a percentage of miles per district as a guideline and Esq. Brown suggested a committee be formed to prioritize the roads.

Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the Court to accept the road project proposals for the six magisterial districts with stipulation to establish a road committee to set up a formula for dividing the funding for next years budget.

RE: EMS/PARAMEDIC UPDATE

Scott McClamroch, EMS Director, reported the ALS Service began on schedule April 2. He noted they were under budget when implementing the ALS Service and he was very pleased with the way it was running. Scott also noted with more staff available the EMS has been making more transports.

RE: 911 REQUEST-KY RIVER FIRE DEPARTMENT

Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court to approve the purchase of batteries and a charger for the KY River Fire Department at a cost of $371.00 with a $500.00 a year cap on batteries.

RE: FSA REQUEST TO GIVE JUDGE/EXECUTIVE POWER OF ATTORNEY FOR COUNTY PROPERTY

Upon motion by Esq. Brown and seconded by Esq. Fisher, it is ordered by the Court to authorize Judge Brent to act as Power of Attorney for County Properties.

RE: AG DISTRICT RECOMMENDATION-290 ACRES OFF OF HWY 574, TURNERS STATION

Upon motion by Esq. Brown and seconded by Esq. Coombs, it is ordered by the Court to approve the Ag District recommendation for 290 acres off Hwy 574, Turners Station, on the Richard Smith, Reggie Brown, Paul W. Brown, and Keith/Laurel Davis farms.

Motion carried unanimously

RE: WATER BOARD RECOMMENDATION FOR H.C. EAST END

Upon motion by Esq. Fisher and seconded by Esq. Gunnell, it is ordered by the Court to accept the recommendation from the Henry County Water District #2 to appoint Ricky Jones to their Board of Directors.

Motion carried unanimously

RE: KENTUCKY HUMANE SOCIETY CONTRACT RENEWAL

Judge Brent informed the Court that he and Trimble County Judge Executive, Randy Stevens, had met separately with the Kentucky Humane Society. They had gotten the Kentucky Humane Society to agree to lengthen its proposed contract from 1 to 4 years and reduce its rate. After considerable discussion the Court approved the 4-year contract at a rate of $83,496.00 per year, with an annual 3% increase beginning July 1, 2008.

RE: PARK UPDATE & REMINDER OF PUBLIC MEETING

Esq. Hawkins gave an update on the Park’s Committee. He encouraged everyone to attend the public meeting for the park plan on April 24, 2007 at 7:00 p.m. at the Extension Office.

RE: COURTHOUSE COMMITTEE UPDATE

Judge Brent gave an update to the Court noting most issues have been addressed and worked out. The carpets have been shampooed, the lock installed at the top of stairway, and the bathroom repairs have been made. Judge Brent noted the price for a commercial air unit for the Courtroom will cost between $20,000.00 and $30,000.00, and Judge Brent reviewed the parking possibilities. After much discussion Judge Brent called for a vote.

Upon motion by Esq. Hawkins and seconded by Esq. Gunnell, it is ordered by the Court to move forward with Option #2 Parking, with Judge Brent to contact the architect engineer to ask him to bring a cost estimate to the Court at the May meeting.

RE: COUNTY CLERK’S OFFICE CARPET RELACEMENT-COUNTY CLERK JUANITA LASHLEY

Upon motion by Esq. Brown and seconded by Esq. Hawkins it is ordered by the Court to accept the price of $6935.38 from Theiss Furniture for carpet for the County Clerk’s Office.

RE: INSURANCE COMMITTEE UPDATE

Deputy Judge Bryant informed the Court that she had met with Brad Stewart from Insuramax Insurance to review and update the County’s Commercial Insurance. As soon as Deputy Judge Bryant gets the information back she will meet with Esq. Beasley and Esq. Gunnell to set the deductibles and get quotes.

RE: ANNOUNCEMENT OF SPECIAL 07/08 BUDGET MEETING

Judge Brent announced a Special 07/08 Budget Meeting would be held on Monday, April 30, 2007 at 5:00 p.m. at the Henry County Courthouse.

RE: COURTHOUSE YARD SALE REQUEST-TOM BALLARD OF NEW CASTLE LIONS CLUB

Tom Ballard with the New Castle Lions Club came before the Court to request the use of the Courthouse Lawn for a monthly yard sale. After much discussion and comments Judge Brent called for a vote.

Upon motion by Esq. Hawkins and seconded by Esq. Fisher, it is ordered by the Court to allow the New Castle Lions Club the use of the Henry County Courthouse Lawn for their yard sale the first Saturday in May, and to allow use of the rest rooms in the Courthouse. The Court will re-evaluate their request to hold a monthly yard sale at next month’s meeting. This is contingent on insurance approval.

RE: COURT COMMENTS

Katherine Vegh and Barbara Campbell came before the Court with information of rumors for the proposed Oldham County Airport. They had maps showing Henry County as the preferred area. Following questions and comments from the Court Judge Brent told them the Court would appreciate their giving an update each month.

Judge Brent informed the Court that Billy Rearden and his wife Connie had lost there home to a fire. A benefit fish fry will be held for them on Saturday, April 28th at the New Castle Fire Department.

Esq. Gunnell encouraged the Court to attend the Transportation Meeting at the Eminence Community Center on April 19th at 1:00 p.m. The meeting is in reference to the Eminence Industrial Access Road and will need to be included in the six year plan.

Esq. Gunnell expressed concerns of a zone change request for Southern States in Eminence. The zone change is a B-2 to an I-2, which would allow for a 30,000 gallon LPG storage tank and propane sales. Esq. Gunnell stated he opposes this zone change due to the health, safety and welfare of the community.

Scott McClamroch, EMS Director, invited everyone to come by the EMS Building at 6:00 p.m. on April 24th and meet the new paramedics.

Danny Cravens, Henry County Sheriff, was proud to report the Henry County Sheriff’s Office has a new self-maintained website.

RE: ADJOURN

Upon motion by Esq. Hawkins and seconded by Esq. Beasley, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and the County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
