The Henry County Fiscal Court met in a regular session on February 19, 2008 at the Henry County Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE
Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.
RE: PRAYER & PREPARATION
Silent prayer was observed in preparation for the meeting.
RE: CALL TO ORDER
Judge Brent called the meeting to order.
RE: APPROVAL OF MINUTES
Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to approve the minutes from the January 15, 2008 regular meeting.
Motion carried unanimously
RE: OLD BUSINESS
There being no old business the meeting proceeded with new business.
RE: NEW BUSINESS
RE: ROAD UPDATE
Due to the absence of Henry County Road Supervisor Glenn Baxter a road update was not presented. Judge Brent asked the Court if they had any road concerns. Esq. Beasley asked for pothole repairs on Byers Lane. Esq. Fisher noted Six Mile Creek Road was in need of attention and Esq. Brown asked for gravel for Turkey Run Road and Gullion Branch Road.
RE: EMS/PARAMEDICS UPDATE AND HIRING REQUESTS
Henry County EMS Supervisor Scott McClamroch was pleased to report his budget is in good shape and he is hopeful to at least break even at the end of this fiscal year. He stated the billing service that does the collections is doing a good job. Scott recommended the Court hire Michael Geoffrey Arth and Carl W. Ball as part-time EMT’s effective immediately. He also recommended paramedic Jim Cox be moved from part-time to full-time status effective March 1, 2008. This would fill the full time position left vacant since December.
Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to hire Michael Geoffrey Arth and Carl W. Ball as part-time EMT’s effective immediately and move paramedic Jim Cox from part-time to a full-time status effective March 1, 2008.

RE: 911 REQUEST - EMINENCE EMS
Upon motion by Esq. Beasley and seconded by Esq. Gunnell, it is ordered by the Court to approve the purchase of two radios for the Eminence EMS in the amount of $1102.50.

RE: VOTING MACHINE DISCUSSION- JUANITA LASHLEY
Henry County Clerk Juanita Lashley presented to the Court the Memorandum of Agreement from the State Board of Elections. It allocates the maximum amount of $90,000 of reimbursement funding from the State for the purchase of additional voting machines. This will fund machines for the County’s twenty precincts. Juanita introduced Megan Harp from Harp Enterprises who demonstrated and explained the escan paper ballot machine. She suggested the County add the paper ballot machines to their precincts as these machines will be used in the future. Megan answered questions from the Court.
Upon motion by Esq. Fisher and seconded by Esq. Brown, it is ordered by the Court to extend bids for the escan paper ballot machine the equivalent equal to the number of precincts in Henry County knowing we will be reimbursed by the State for one machine to the number of precincts in Henry County.

RE: EMINENCE POOL PRESENTATION-DOUG & MANDA GINGRICH
Manda Gingrich chairperson of the Eminence Pool “Making Waves” and Richard Thomas pool commissioner came before the Court to discuss re-opening the Eminence Swimming Pool. Manda told the Court their committee had received positive results while they have been knocking on doors, getting signatures of support and asking for donations from the community. One example of support came from the City of Eminence as they re-budgeted $150,000 towards the project. She stressed the need for a public pool and told the Court they would greatly appreciate a monetary donation. Esq. Gunnell and Esq. Beasley stressed this pool is a community pool and is the only public pool in the County.
Upon motion by Esq. Gunnell and seconded by Esq. Beasley, it is ordered by the Court that after the City expends their $150,000 towards the project and pending that the bids come in showing that funding is still needed that a one-time donation in the amount of $2500 be given towards the pool project. This donation will be put in the 2008-2009 budget.

RE: PARK UPDATE
Judge Brent informed the Court that Cedar Lake Lodge is not going to make a final decision concerning the building of their group home until this summer. They have talked with their representatives and are still hopeful regarding the sewer project.
RE: VERIZON CELL TOWER UPDATE
Judge Brent reported that last fall Tammy Smith with Verizon had come to the Court requesting a location on County property for a new cell tower. The committee had met and made recommendations but Tammy had not gotten back with them. Judge Brent made contact with Verizon and learned that Tammy is no longer working for Verizon. Judge Brent was told a decision has not been made on the location of the tower as Verizon is not moving on the issue at this time.
RE: AG DISTRICT RECOMMENDATIONS
Upon motion by Esq. Brown and seconded by Esq. Coombs, it is ordered by the Court to recommend that the Soil Conservation Board accept into Ag Districts the following:
Robin Fergerson/ 4171 Sunnyside Road Smithfield, KY-306 Acres, Mark & Kim Smith/9615 Applewood Court Crestwood, KY-103 Acres, Gary Stivers/ 2616 Port Royal Rd. Campbellsburg, KY, & Stivers Farm/2366 Port Royal Rd. Campbellsburg, KY-540 Acres and Brian Stivers/206 Long Branch Rd. Turners Station, KY-46 Acres.
Motion carried unanimously
RE: EXCESS FEES PRESENTATIONS-HENRY CO. CLERK JUANITA LASHLEY& HENRY CO. SHERIFF DANNY CRAVENS
Henry County Clerk Juanita Lashley presented the Court a check in the amount of $57,658.51 for excess fees.
Henry County Sheriff Danny Cravens presented the Court the Sheriff’s Settlement and reported excess fees in the amount of $78,636.79.
Judge Brent thanked the Clerk and Sheriff for their hard work. He explained that excess fees were important because retirement, health insurance, and social security were paid for these departments out of the County’s budget.
RE: INTER-LOCAL AGREEMENT WITH LAKE JERICHO FIRE DEPT
Upon motion by Esq. Coombs and seconded by Esq. Gunnell, it is ordered by the Court to enter into an Inter-Local Agreement with the Lake Jericho Fire Department and the Henry County Road Department. The agreement allows the Henry County Road Department to haul rock to the Lake Jericho Fire Department construction project with Lake Jericho Fire Department paying all cost of the rock material.

RE: COURT COMMENTS
Esq. Gunnell informed the Court that Wildcat Tractor in Eminence had been bought by Emeco Equipment. Esq. Coombs wanted to commend the County Road Department for a good job on the roads this winter. Virginia Harrod thanked the Court for the Get Well Cards and Get Well Wishes while she was recovering from her surgery.
Katherine Vegh told the Court she had heard rumors concerning the Oldham County Airport but she did not have concrete information for the Court at present time.
Christina Poole with Congressman Geoff Davis’s Office informed the Court that her office had helped obtain a Grant for the Pleasureville Fire Department in the amount of $41,756.00. The funding will be used for safety and operations equipment.
RE: ADJOURN
Upon motion by Esq. Beasley and seconded by Esq. Fisher, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and the County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
