HENRY COUNTY FISCAL COURT MINUTES

 

REGULAR SESSION
MAY 20, 2008

Notice:  These are the "unofficial" minutes of the Henry County Fiscal Court Meetings.  By procedure, these minutes will not be official until after the next regular council meeting is held and minutes are approved.

The Henry County Fiscal Court met in a regular session on May 20, 2008 at the Henry County Courthouse in New Castle, Kentucky with the following in attendance:

RE: PLEDGE OF ALLEGIANCE

Judge Executive John L. Brent led the Court in the Pledge of Allegiance to the Flag.

RE: PRAYER & PREPARATION

Silent prayer was observed in preparation for the meeting.

RE: CALL TO ORDER

Judge Brent called the meeting to order and noted everyone was present.

RE: APPROVAL OF MINUTES

Upon motion by Esq. Brown and seconded by Esq. Gunnell, it is ordered by the Court to approve the minutes from the April 15, 2008 Regular Meeting.

Motion carried unanimously

Upon motion by Esq. Beasley and seconded by Esq. Coombs, it is ordered by the Court to approve the minutes from the April 30, 2008 Special Budget Meeting.

Motion carried unanimously

RE: OLD BUSINESS

RE: 2ND READING OF THE PROPOSED 2008/2009 BUDGET ORDINANCE

Judge Brent informed the Court that the State Local Finance Officer had approved and returned the proposed budget with the recommendations to change the coding on the following 2 line items: Capital Project Park Purchase from: 01-7500-718 to: 01-7600-742 and Capital Project (Annex/Building) from: 01-7500-742 to: 01-7600-699. Judge Brent asked for questions and comments and then called for a vote.

Upon motion by Esq. Beasley and seconded by Esq. Hawkins, it is ordered by the Court to approve the second reading of the 2008-2009 Budget with the budget attachment.

Motion carried unanimously

RE: NEW BUSINESS

RE: ROADS

1. Supervisor update

Henry County Road Supervisor Glenn Baxter informed the Court that in conjunction with the Kentucky Association of Counties (KACO), he will be accepting bids via a Reverse Online Auction for the purchase of road salt. He is also getting prices from his current vendor.

2. Union Church Road

Glenn gave an update on the Union Church Road project. He noted the repairs were looking good as they hit clay dirt much faster than expected. He felt the project would be completed by the end of the week and they would be under the projected cost estimate. Judge Brent noted he had sent a request of $44,000.00 to the State for Emergency Road Aid for the estimated cost of labor and rock. Judge Brent has not received a definite response but is hopeful the County will get something from the State. Judge Brent complimented the Court for working as a team to get this job done.

3. Authorize Bids for Rock, Hot Mix, and Cold Mix for 2008-2009

Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to authorize Judge Brent to advertise bids for rock, hot and cold mix with sealed bids to be opened at 6:00 p.m. at the June 17, 2008 Regular Meeting of Fiscal Court.

RE: EMS

1. Supervisor Update

Henry County EMS Director Scott McClamroch informed the Court this is EMS week. He invited the Court to come by the EMS Building for a cookout following the meeting.

2. Hiring requests

Scott recommended James S. Baker, Jr. and Dennis R. Tegethoff be hired as part-time EMT’s.

Upon motion by Esq. Gunnell and seconded by Esq. Fisher, it is ordered by the Court to hire James S. Baker, Jr. and Dennis R. Tegethoff, Jr. as part-time EMT’s.

Motion carried unanimously

RE: PARKS UPDATE

1. Sewers

Judge Brent informed the Court that he and Esq. Hawkins had attended the New Castle City Council Meeting. The state allocation will extend the sewers to the county’s new park site. The New Castle City Council voted unanimously to move forward with the project. Scott Treece is moving on this project and hopes to have it finished this fall or winter.

2. Walking Trails

Judge Brent noted the County received $50,000.00 in grant funding for the walking trails. The County is required to have an archeological study before they can receive the federal money. Judge Brent asked the Court to allow him to enter into a contract to conduct the study.

Upon motion by Esq. Hawkins and seconded by Esq. Brown, it is ordered by the Court to allow Judge Brent to enter into a contract with a company that will conduct the archeological study.

Motion carried unanimously

RE: COMMERCE PARK/KIPDA AGREEMENT

Judge Brent reported the money received for the Campbellsburg Commerce Park infrastructure is federal money through HUD which requires a lot of paperwork, including an environmental study. He suggested the Court authorize KIPDA to administer the project at 2% of cost and to allow KIPDA to contract with a company to conduct the environmental and archeological studies on the property.

Upon motion by Esq. Brown and seconded by Esq. Hawkins, it is ordered by the Court to allow KIPDA to administer the paperwork at 2% of cost and to authorize KIPDA to contract with a company to conduct the environmental and archeological studies.

Motion carried unanimously

RE: LAKE JERICHO FIRE DEPARTMENT/COMMUNITY CENTER UPDATE

Esq. Coombs gave the Court an update on the Lake Jericho Fire Department/Community Center. He stated the doors will be up on Friday and they will start the wiring. It should be completed no later then the end of June. Esq. Coombs was pleased to inform the Court that Lake Jericho Fire Department had received a FEMA Grant for a new fire truck.

RE: COURTHOUSE USE POLICY COMMITTEE REPORT

Esq. Hawkins reported that he and Esq. Gunnell met with Henry County Circuit Court Clerk Mary Lou Roberts to make a policy for the use of the Courthouse. He brought the committee’s recommendation in the form of a motion.

Upon motion by Esq. Hawkins and seconded by Esq. Gunnell, it is ordered by the Court to allow the use of the Henry County Courtroom to any adult oriented government, political, or civic organization at no charge, and for the use to be subject to approval by the Henry County Circuit Court Clerk’s Office.

Motion carried unanimously

RE: AG DISTRICT RECOMMENDATIONS

Upon motion by Esq. Brown and seconded by Esq. Coombs, it is ordered by the Court to make the recommendation for a total of 2,046 acres to be established as a new Ag District #052-20 for the following petitioners: Terry A. Rowlett, Howard A. Rowlett, Zane O. Peyton, Jane B. Burkhead, Randall S. Tingle, Edward P. Smith, David L. Pyles, Joseph O. Moberly, James C. Mobley, Robert R. Bush II, Mark H. Boyer, Merle Brewer, William David Barnett, Michael A. Loaring, Rosalee Grigsby, Dennis R. Brown, Robert R. Bush, Stanley Snowden, Mary Ann Courtney, and Jerry W. McCandless.

Motion carried unanimously

RE: INSURANCE COMMITTEE-ESTABLISH COMMITTEE & SET MEETING DATE

Judge Brent informed the Court that he had asked Greg Derossett to review the County’s liability insurance policy. The areas in question are events held at the fairgrounds and park such as running events and car shows. Judge Brent suggested the insurance committee meet with Joe Greathouse from KACO to get clarification on coverage for these special events. Esq. Gunnell asked Peggy Bryant to contact Joe Greathouse and set up a meeting with Joe and the insurance committee.

RE: CHAIR/TABLE USE POLICY AT 4-H CENTER

Judge Brent asked the Court to give him direction on allowing citizens to borrow tables and chairs from the 4-H building. There was discussion from the Court on requiring a deposit or possibly renting the tables and chairs. Esq. Gunnell suggested the Court also make guidelines for use of the bleachers. Judge Brent will meet with the committee of Esq. Coombs and Esq. Hawkins to discuss the issue and will bring their recommendations back to the Court.

RE: MEMORANDUM OF AGREEMENT-HENRY COUNTY CLERK’S OFFICE/HENRY COUNTY HISTORICAL SOCIETY

Judge Brent asked the Court for permission to sign the Memorandum of Agreement between the Henry County Clerk’s Office and the Henry County Historical Society. The agreement allows for the archival records that are stored in the basement of the Henry County Courthouse be moved to the Henry County History Center. The records will remain under the ownership of the Henry County Clerk.

Upon motion by Esq. Brown and seconded by Esq. Coombs, it is ordered by the Court to allow Judge Brent to sign the Memorandum of Agreement between the Henry County Clerk and the Henry County Historical Society.

RE: QUITCLAIM DEED-HARTLAGE/LAWSON PROPERTY

Henry County Attorney Virginia Harrod reminded the Court that in April 2006 they had deeded back to the property owners an old dedicated road. A new survey of the property showed the deed had an error and she is requesting the Court give Judge Brent the authorization to sign the corrected deed.

Upon motion by Esq. Fisher and seconded by Esq. Beasley, it is ordered by the Court to authorize Judge Brent to sign the corrected deed for the Hartlage/Lawson Property.

RE: COURT COMMENTS

Esq. Brown thanked the road department for their assistance following the storm and heavy rains. He also announced an upcoming training on Pipeline Operators of KY. He felt the Court could benefit from attending and possibly get training hours as well. Esq. Gunnell commented on the 2008-2009 Budget noting it was one of the better budgets.

Upon motion by Esq. Brown and seconded by Esq. Beasley, it is ordered by the Court to adjourn and each Magistrate, the Judge Executive and the County Attorney shall receive a typed copy of these minutes prior to the next regularly scheduled meeting.
